Conditions for Participation in the “free stem cell storage” Competition

1. Organiser

This Competition is organised by FamiCord Suisse SA, Sumpfstrasse 26, 6312 Steinhausen (the “Organiser”).

2. Right to Participate

  1. All natural persons of the female sex who have reached the age of 18 at the time of their participation, are permanently resident in Switzerland and are pregnant at the time of their participation are eligible to participate. Participation is only possible in one’s own name.
  2. Employees of the Organiser and its affiliated companies are not entitled to participate.

3. Period of the Competition

The competition takes place every month. During this period, new entry forms will be accepted.

4. Participation in the Competition

  1. Participation may happen via social media channels (Facebook, Instagram and others) as well as “Landing Pages”. In order to participate, the participation form must be completed in full and submitted.
  2. The entry form must be completed in full with the name of the participating mother, the expected birth date, e-mail address and telephone number. In order to participate in the competition, it is necessary that all details in the entry form are true. Each entrant may submit only one entry form. Multiple submissions will not be considered.
  3. If a participant no longer wishes to take part in the competition, she can unsubscribe at any time at the following e-mail address: kundendienst@famicord.ch
  4. Participation in the competition is free of charge and does not depend on the conclusion of a legal transaction.

5. Modalities of the Drawings

  1. The draw will take place at the end of the competition period. A winner will be drawn on the 5th and 15th of each month.
  2. There shall be one winner per draw. Only one prize can be awarded per participant.
  3. The drawings are made using a computer-aided procedure. The drawings will take place under exclusion of the public at the Organiser’s headquarters in Zug. No correspondence will be entered into regarding the drawings.

6. Prize

  1. A voucher for a standard storage of umbilical cord blood will be given (blood standard package), one per draw. The value of each voucher is CHF 3,350 (LUX: 2400 euros). This amount includes the cost of the collection kit, transport to the organiser’s laboratory and storage in the organiser’s cord blood bank for 25 years.
  2. If the winner decides to use additional services from the Organiser at the moment of the redemption of her voucher or afterwards, she has to pay the price difference to her prize herself.
  3. Each voucher is valid for a period of 9 months from the date of receipt by the winner.
  4. The voucher cannot be exchanged and is not transferable or saleable. There is no entitlement to payment of the prize in cash or to the issue of a substitute prize.
  5. If the cord blood sample cannot be stored due to eligibility reasons, there will be no payout of the value of the sample to the winner.
  6. All costs, taxes and fees associated with the prize shall be borne by the winner.
  7. The prize cannot be exchanged and is not transferable or saleable. There is no entitlement to payment of the prize in cash or to the issue of a substitute prize.

7. Notification and Confirmation of Winners

  1. The winners will be informed of their prize by telephone or E-Mail within five working days of the draw at the contact details indicated on the entry form.
  2. The Organiser will attempt to contact the winner a maximum of three times at intervals of at least three days. If the winner cannot be reached for reasons for which she is responsible, the prize will be forfeited.
  3. Winners whose contact details change after notification of the prize are obliged to notify the Organiser of the changes.

8. Award of the Prize

  1. The vouchers will be sent to the winners within five working days of the draw. The vouchers will be delivered electronically to the e-mail address given on the entry form.
  2. If a voucher cannot be delivered for reasons for which the winner is responsible, the voucher shall lapse.
  3. The voucher also lapses if for medical reasons or for other reasons beyond the control of the Organiser the collection or storage of the umbilical cord blood of a winner is not feasible.
  4. By accepting and using the voucher, the winner agrees to the collection of the blood by a trained midwife using a collection kit, transport to the Organiser’s laboratory and storage in the Organiser’s umbilical cord blood bank for 25 years.

9. Exclusion from the Competition, Premature Termination, Liability

  1. The Organiser reserves the right to disqualify participants who manipulate or attempt to manipulate the raffle and/or violate the conditions of participation or good manners and/or otherwise attempt in an unfair manner to influence the raffle without stating a reason and to exclude them from the raffle without notice or to confiscate their winnings and reclaim them if necessary.
  2. The Organiser reserves the right to cancel or prematurely terminate the competition at any time without prior notice and without giving reasons. This applies in particular if a proper execution cannot be guaranteed for technical or legal reasons. In such a case the participants are not entitled to any claims against the Organiser.
  3. The Organiser accepts no liability towards the winners for loss or damage of any kind arising from or in connection with the competition, data processing and the prize.

10. Use and Protection of Data

  1. The personal data of the participants collected during participation in the competition will be collected, processed and used for the purpose of conducting the competition.
  2. In addition, by participating, each participant agrees that his/her personal data, such as first and last name, address, e-mail address and telephone number, may be used by the Organiser for statistical and advertising purposes. The Organiser may also pass on this data to service providers for the purpose of handling the competition, who will take on all or part of the tasks required to complete the competition (e.g the transport company). The obligation of these service providers is analogous to the data protection regulations.
  3. By participating in the competition, the participants agree that the Organiser will store all personal data for the duration of the competition and beyond this period.
  4. The Organiser undertakes to comply with Swiss data protection and media law provisions for the personal data of the participants. The data of the participants will be treated confidentially.
  5. There is no guarantee that data transmitted electronically will not be accessed or lost by third parties.

11. Applicable Law and Legal Recourse

  1. These conditions for participation are subject to Swiss law.
  2. Legal recourse is excluded.
